The Service provides case assessment tools and scoring based on information provided by users. These assessments are for informational purposes only and should not be considered medical advice or a substitute for professional medical judgment.

This application has not been evaluated or approved by the U.S. Food and Drug Administration (FDA) or any other regulatory body as a medical device.

1. Agreement to Terms

By accessing or using Halcyon Intake (the "Service"), provided by Effinger Law("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after any modifications indicates your acceptance of the updated Terms.

Halcyon Intake is a case intake and assessment platform designed for legal professionals handling Social Security Disability (SSD) claims. The Service provides:

  • Case viability scoring and recommendations
  • Client intake management tools
  • Case tracking and workflow management
  • Disability screening assessments

3. User Accounts

To access certain features of the Service, you must create an account. You agree to:

  • Accept responsibility for all activities under your account

You retain ownership of any content you submit to the Service. By submitting content, you grant us a limited license to use, process, and store such content solely for the purpose of providing the Service. You represent that you have all necessary rights to submit such content and that it does not violate any third-party rights.

8. Subscriptions and Payments

Certain features of the Service require a paid subscription. By purchasing a subscription, you agree to:

  • Pay all applicable fees as described at the time of purchase

  • Authorize recurring charges for subscription renewals

Subscriptions renew automatically unless cancelled before the renewal date. Refunds are provided in accordance with our refund policy.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

WE MAKE NO WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CASE ASSESSMENTS, SCORES, OR RECOMMENDATIONS PROVIDED BY THE SERVICE. SUCH INFORMATION IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EFFINGER LAW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Effinger Law, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Florida.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
